Terms of Service

Last updated: April 2026

Version: 1.0 — Draft
Effective date: April 2026
Operator: Lukas Köhler, Hybrid Athlete, Tyrol, Austria

1. Acceptance of terms

By creating an account on Hybrid Athlete (hybridathlete.dev), you agree to these Terms of Service. If you do not agree, do not use the platform.

The platform is currently in early access / pre-launch phase. Features may change, be unavailable, or behave unexpectedly. This is expected during active development.

2. Who can use the platform

You must be at least 16 years old to use Hybrid Athlete. The platform is intended for personal, non-commercial use by individual athletes tracking their own training.

During early access, use is by invitation only. We reserve the right to remove access at any time.

3. Your account

  • You are responsible for keeping your login credentials secure
  • You are responsible for all activity under your account
  • You must not share your account with other people
  • You must provide accurate information during onboarding (HR max, HR rest, bodyweight) — inaccurate data will produce incorrect HDSS scores

4. Garmin Connect integration

If you connect your Garmin account:

  • You authorise Hybrid Athlete to access your Garmin activity and health data via Garmin's official OAuth 2.0 API
  • This connection is voluntary and can be revoked at any time
  • Hybrid Athlete is not affiliated with Garmin Ltd. Garmin's own terms of service and privacy policy apply to your use of Garmin Connect
  • We are not responsible for data availability, accuracy, or delays from the Garmin API

5. Training data and health information

Important: Hybrid Athlete is a training management tool, not a medical device or clinical health platform.

The HDSS (Hybrid Daily Stress Score) and ACWR (Acute:Chronic Workload Ratio) are training planning tools based on published sports science models. They are not medical advice.

Do not make health or medical decisions based solely on data from this platform. If you experience pain, injury, or illness, consult a qualified healthcare professional.

The model coefficients are hypothesis-driven and subject to ongoing validation — treat scores as guidance, not ground truth.

6. Academic research

The platform is used as a data collection tool for a Bachelor's thesis at MCI Innsbruck. If you consent during onboarding:

  • Your anonymised training data may be included in the thesis dataset
  • No personally identifiable information is used in any published research
  • You can withdraw consent at any time without losing access to the platform

7. Acceptable use

You must not:

  • Attempt to reverse engineer, scrape, or extract data from the platform beyond your own
  • Use the platform to train machine learning models or build competing products without permission
  • Attempt to access other users' data
  • Abuse the API or attempt to circumvent rate limits
  • Use the platform for any illegal purpose

8. Service availability

Hybrid Athlete is provided "as is" during the early access phase. We make no guarantees of uptime, data retention, or feature continuity. We will give reasonable notice before any major changes or shutdowns, but this is not guaranteed during pre-launch development.

9. Limitation of liability

To the maximum extent permitted by Austrian law, Lukas Köhler and Hybrid Athlete are not liable for:

  • Training decisions made based on platform data
  • Data loss due to service interruptions
  • Inaccuracies in HDSS or ACWR calculations
  • Any indirect, consequential, or incidental damages

10. Governing law

These terms are governed by Austrian law. Any disputes will be subject to the jurisdiction of the courts of Tyrol, Austria.

11. Changes to these terms

We will notify you by email at least 14 days before any material changes take effect. Continued use after that date constitutes acceptance.
